Andrew J. Schwab Obtains $375,000 Settlement in Malpractice Claim

 

Our clients were the next of kin of a decedent who died from self-induced ethylene glycol (anti-freeze) poisoning. The estate's original attorney failed to commence a timely action for the  decedent's wrongful death. 

The decedent's spouse had called 911 to report the decedent's suicidal threat, and he was taken into custody by police for a psychiatric evaluation.  The hospital and physician, however, discharged the decedent despite the fact that he was already under the influence of the ethylene glycol that he had ingested in his suicide attempt.  The decedent was found in his car 24 hours after his discharge from the hospital.  The settlement represented only damages for the wrongful death of the decedent.
