The Plaintiff, Donald Dove alleged that while incarcerated at the Broome County Correctional Facility he was deprived of various civil rights when the jail refused to serve him with a Kosher meal tray. More particularly, he claimed that the actions of the Jail and the Jail Chaplain unlawfully interfered with his right to exercise his religion, denied him Due Process of Law and violated the Federal Religious Freedom Restoration Act.
The Court held that despite the plaintiff's allegations in the complaint, the case should be dismissed prior to discovery as the plaintiff's rights were not unreasonably denied.
