SG Obtains Pre-Answer Dismissal Win in Ulster County

Louis U. Gasparini and Caitriona Robbins recently obtained a pre-answer dismissal of a Complaint filed in Ulster County Supreme Court alleging that our client engaged in acts constituting defamation, discrimination, harassment, hostile work environment, retaliation and constructive termination in violation of New York State Human Rights Law and New York State Labor Law.

SG successfully argued that the plaintiff’s claims for defamation were time barred by the statute of limitations, and that the remaining causes of action sounding in harassment, hostile work environment, retaliation and constructive termination in violation of the NYSHRL and NYLL failed to state a claim because no individual liability can attach where no employer-employee relationship exists. Our client was a co-employee of plaintiff and had no role in administering compensation, terms, conditions or privileges of employment. The Court granted our motion and dismissed the plaintiff’s claims against our client.
