In Kalle v. Greentree Country Club (Westchester County), plaintiff was injured when a number of patrons at a Sweet 16 began breaking plates while dancing. A piece of a broken plate struck plaintiff in the eye, causing loss of vision in the teenage plaintiff. SG moved for summary judgment, arguing that the plate breaking started suddenly and without warning, and plaintiff's injury could not have been prevented by any reasonable degree of supervision. The Court agreed with these arguments, and dismissed plaintiff's Complaint.
