Plaintiff claimed that she was sexually abused by her foster father while she was under the care of a group home in the late 1970’s. Despite recent enactments of the Child Victims Act extending the statute of limitations to commence an action, SG submitted a Motion to Dismiss in lieu of an Answer arguing that the action was barred by the Statute of Limitations. The Supreme Court, New York County agreed and dismissed the plaintiff’s Amended Complaint with costs. Carolyn Chieco Loftus handled the matter on behalf of SG.
