SG Obtains Summary Judgment for Synagogue Client

Partner Tim Tuttle obtained summary judgment dismissing the plaintiffs' Complaint against the firm's client, a Synagogue which had entered into a triple-net lease with plaintiff's employer. The plaintiff slipped on a puddle of water within the building during the course of her employment and alleged that the Synagogue had retained sufficient control of the building to be held responsible for the alleged leak from the roof.

Tuttle argued that the firm's client was an out-of-possession landlord that had transferred all obligations for repair and maintenance of the property to plaintiff's employer under the provisions of the triple-net lease. The Court agreed with these arguments and granted the motion for summary judgment, dismissing the Complaint as against the Firm's client. Notably, plaintiff did not file a Notice of Appeal.
